WHAT IS A SIG SAUER P320?
The Sig Sauer P320 is a striker-fired, semi-automatic pistol made by SIG Sauer, Inc. in New Hampshire. After landing a massive deal to supply these pistols to the U.S. Army, Sig Sauer made these pistols for law enforcement and the general public. While Sig Sauer designed external safeties into each P320 sold to the military, they did not carry this design over to the non-military P320s. The vast majority of P320 models for sale to federal agencies, law enforcement agencies, and the general public do not even offer external safeties as an option.
IS THE SIG SAUER P320 PRONE TO FIRING WITHOUT A TRIGGER PULL?
These guns are prone to firing without anyone ever pulling the trigger. Sig Sauer was ordered to fix the pistols for the military but continued to sell the commercial version of the gun without the fix. Even with a “voluntary upgrade” later offered for these pistols, the Sig Sauer P320 is still operating with a “potentially deadly design defect,” which can inadvertently discharge, even when the gun is holstered, according to multiple lawsuits filed.
WHO HAS FILED DEFECTIVE FIREARMS LAWSUITS?
Numerous cases have been filed by Saltz Mongeluzzi Bendesky on behalf of victims of defective, misfiring handguns. Many of the victims include police officers, federal agents, and veterans.
- The largest mass action cases filed to date on behalf of 34 P320 owners from 23 states who were injured from unintentional discharges.
- A product liability and negligence lawsuit was filed against Sig Sauer on behalf of 22 victims across 16 states who were injured when their P320s unintentionally discharged.
- A wrongful death lawsuit was filed against Sig Sauer after a man was killed by his holstered P320.
- A federal court jury in Georgia awarded more than $2.35 million in damages to a man who was seriously injured in 2018 when his holstered Sig Sauer P320 handgun fired without him ever touching the trigger.
- A Philadelphia jury awarded $11 million in damages to U.S. Army veteran George Abrahams, who was shot by his Sig Sauer P320 pistol while it was in its holster and without his hands touching the gun.
