Aqueous Film-Forming Foam (AFFF) is a firefighting foam used on military bases and for class B fires. AFFF contains dangerous PFAS chemicals, including PFOS and PFOA. Larry is one of a select group of attorneys appointed to the Plaintiffs’ Executive Committee (PEC) in the Federal Court AFFF Multi-District Litigation (MDL) in South Carolina and Josh currently sits on two leadership committees in the ongoing AFFF MDL. This litigation includes thousands of lawsuits that were originally filed across the country against the 3M Company, Dupont, and other manufacturers seeking damages for the widespread harm caused by the use of AFFF/PFAS.

In addition, Larry serves on the executive committee for the class action lawsuit for medical monitoring on behalf of residents in Bucks and Montgomery counties affected by PFAS contamination.

Recent settlements reached in the AFFF MDL on behalf of public water providers include:

  • $12.5 Billion Settlement with 3M Company
  • $1.185 Billion Settlement with Dupont, Chemours, Corteva
  • $750 Million Settlement with Tyco Fire Products LP
  • $316.5 Million Settlement with BASF Corporation

The settlement reached with 3M was the largest water contamination settlement in United States history.

At the present time, Saltz Mongeluzzi Bendesky is no longer accepting new cases on behalf of individuals who consumed PFAS-contaminated water and later developed one of the above listed injuries, pending further direction from the Court.

Litigation Update

The first personal injury trial in the AFFF MDL was set to begin in October 2025 and was going to involve a Pennsylvania Plaintiff who had been diagnosed with kidney cancer after consuming PFAS contaminated water for decades. Saltz Mongeluzzi Bendesky attorneys Larry Cohan and Josh Cohan are part of the trial team that will be trying the first case in the country in the AFFF MDL. However, the trial date was put on hold by the Court and has not yet been rescheduled.  We anticipate that the trial will be rescheduled in 2026.

Additionally, the AFFF MDL saw a surge of new filings in August and September 2025.  The litigation has been pending for years and up until recently, there were less than 20,000 filed cases.  A recent rash of new legal filings, following the entry of a Court Order, has brought the total number of filed cases to well over 100,000.  The Court recently placed a quasi-moratorium on new personal injury case filings, meaning that there are substantial additional barriers that potential Plaintiffs must face if they intend  to pursue an AFFF lawsuit after September 10, 2025.
