Benjamin J. Eichel

Ben litigates all types of commercial disputes, with both domestic and international implications, including, but not limited to, construction disputes, employee/employer disputes, shareholder or partnership agreements, commercial landlord and tenant disputes, RICO actions, and disputes relating to the ownership of intellectual property.

In antitrust and unfair competition matters, Ben represents clients in litigation involving  price-fixing, price discrimination, predatory pricing, monopolistic practices, group boycotts, and tying and exclusive deals, among other areas.

Ben represents clients in all aspects of litigation, from initial pleadings through appeals, in both state and federal courts, as well as representing clients in alternative dispute resolution procedures, including arbitration and mediation. He has represented clients before the American Arbitration Association, the International Centre for Dispute Resolution, Judicial Arbitration and Mediation Services, and the International Chamber of Commerce.

Before joining Saltz Mongeluzzi Bendesky, Ben was a Partner with Boni, Zack & Snyder. Previously he was an associate and of counsel in the commercial litigation departments of Pepper Hamilton, LLP and Archer & Greiner, P.C., where his experience included working on antitrust matters, commercial litigation, and international arbitration.

Ben has maintained an active pro bono practice throughout his career. His work in civil rights cases has included representing a Pennsylvania prisoner in a Section 1983 action relating to inadequate medical care while in state custody. He has also worked with the nonprofit organization Women Against Abuse, representing clients in court seeking protection from domestic abuse. He has also worked protecting Pennsylvanians’ right to vote in recent elections.

Ben has been named to Pennsylvania SuperLawyers in 2023 – 2026. Ben is a graduate of the University of Michigan and Boston University School of Law. He is admitted to practice in Pennsylvania, New  Jersey, and numerous federal courts.

• Conry v. Gerber Products Co., 24-cv-6784 (E.D.N.Y.) (antitrust action concerning the sale of store brand baby formula)
• Tipsy Nail Club LLC v. ClassPass Inc., No. 21 Civ. 8662 (AT) (SN) (Lanham Act and unfair competition class action settlement)
• In re Generic Pharmaceuticals Pricing Antitrust Litig., MDL 2724, 16-MD-2724 (E.D.  Pa.) (antitrust class action pending)
• Bucks County v. Purdue Pharma L.P. (Pennsylvania Coordinated Opioid Proceedings), CV-2017-008095 (Delaware Cty. Ct. Common Pleas) (litigation and partial proposed settlements pending)
• In re Interior Molded Doors Antitrust Litig., Lead Civil Action No. 3:18-cv-00718-JAG (E.D. Va.) (antitrust class action settlement)
• Represented a New Jersey company in disputes relating to the distribution of personal protective equipment in Florida and New Jersey federal courts
• Represented a manufacturer of polyurethane foam in defense of a price fixing and customer  allocation action brought by direct purchasers
• Represented a hospital system in an antitrust dispute with its largest competitor
• Represented one of the largest suppliers of packaged tuna against price fixing claims
• Represented a mushroom supplier against claims of price fixing
• Represented two German affiliates of a global leader in the semiconductor market in an  International Chamber of Commerce arbitration seated in Paris under Belgian law concerning a joint research and development project
• Represented a Pennsylvania education technology company against a German supplier in Swiss arbitration
• Represented a subcontractor against the owner in a mechanic’s lien action relating to work  performed to renovate a Philadelphia hotel
• Represented a large, multi-office medical practice in disputes against multiple partner physicians relating to a planned private equity buyout, which were resolved favorably for the practice
• Represented employees and their employer in a dispute over a non-compete agreement and breach of contract claims relating to the use of water purification technology in arbitration against their former employer
• Represented a shareholder against a fellow shareholder in a complex dispute regarding ownership of companies located in Dubai. The case involved legal actions in Pennsylvania, New Jersey, London, and Dubai.
