Another Federal Jury Unanimously Finds Sig Sauer P320 Pistol Defectively Designed, Caused Plaintiff’s Injuries

Saltz Mongeluzzi Bendesky’s trial team, which proudly represents former Cambridge, MA Police Officer Jacques Desrosiers, presents the below statement following the verdict yesterday after a two-week trial in his federal product liability lawsuit, Derosiers v. Sig Sauer, Inc., Case No. 1:22-cv-11674.

On October 10, 2019, Officer Desrosiers was injured when his duty-issued Sig Sauer P320 unintentionally discharged. This was one of four unintended discharges among Cambridge Police Officers after the department switched to the P320. This should never have happened. The Cambridge Police Department, like many other law enforcement agencies nationwide, made the responsible decision to abandon the P320 and has purchased other safer alternative pistols for its officers.

After the two-week trial where the jury carefully weighed the evidence, all 10 jurors unanimously concluded that the P320 is defectively designed and those defects caused Officer Desrosier’s injury.

This is now the third jury that has told Sig Sauer that the P320 is defectively designed, unreasonably dangerous, and caused the plaintiff’s injuries. While the jury found that Mr. Desrosiers used the P320 knowing it was defective, which does not permit him to recover damages under Massachusetts law, this verdict again emphatically shows that the P320 is prone to injuring – even killing – those that are issued or carry the gun for protection. It must be recalled or redesigned so that it stops injuring and killing its users who rely on the weapon.
