Settlement on Behalf of a Forklift Operator in Philadelphia
On April 7, 2021, SMB attorneys Larry Bendesky, Adam J. Pantano, and Jordan Howell secured a $1,500,000 settlement on behalf of a forklift operator in Philadelphia who was injured when attempting to load a pallet into a box truck.
On April 7, 2021, SMB attorneys Larry Bendesky, Adam J. Pantano, and Jordan Howell secured a $1,500,000 settlement on behalf of a forklift operator in Philadelphia who was injured when attempting to load a pallet into a box truck.
Due to the negligence of the truck driver who failed to properly park and chock the wheels of the truck at the loading dock, the truck rolled forward causing the forklift to fall from the loading dock. The forklift operator suffered a compression fracture of the L1 vertebrate, T12 spinous process fracture and transverse process fractures of L1-2.
The Defendant argued the Plaintiff was responsible for ensuring that the truck was properly parked and that the wheels were chocked. The defendant also argued that the Plaintiff should have been wearing a seatbelt while operating the forklift.
The case was successfully resolved at mediation.
