It’s Not Just A Car Accident When A Product or Roadway Defect Is Involved

Fundamentally, a car should protect its occupants in a crash, not expose them to enhanced injuries. Auto and tire manufacturers, for example, are obligated to design and distribute vehicles and tires capable of withstanding regular use. Sometimes cars and tires do not perform as expected, causing crashes or creating a more catastrophic injury than would have otherwise occurred.
Similarly, cities, counties and states are obligated to design and maintain roadways to eliminate defects that may cause drivers to lose control of their vehicles. There are often accident history records maintained for roadways and, on occasion, those responsible for safety chose not to act in response to repeated accidents at a particular location. Like product manufacturers, cities, counties and states are obligated to protect the motoring public from hazards.
