Historic Settlements Reached Over AFFF Public Water Contamination, Now Exceeding $14 Billion

Saltz Mongeluzzi and Bendesky is proud to announce numerous historic settlement agreements with major corporations over contaminated public water systems in the nationwide Aqueous Film-Forming Foam (AFFF) Products Liability Multi-District Litigation (MDL). 

3M has committed to pay a staggering $12.5 billion to support public water systems throughout the United States that detect PFAS chemicals. Moreover, both DuPont and Tyco Fire Products have agreed to pay $1.185 billion and $750 million respectively. Recently, as of May 21, 2024, BASF Corporation has also agreed to pay $316.5 million. Totaling approximately $14.8 billion, these settlements mark a historic milestone as the largest-ever public water contamination settlement, paving the way for safe, clean drinking water across the nation.

Saltz Mongeluzzi Bendesky Partner Larry Cohan serves as a member of the Plaintiffs Executive Committee for the AFFF MDL. In that capacity, Cohan successfully represented two of the first 10 chosen bellwether cases. These cases were on behalf of Pennsylvania public water providers in Warminster and Warrington, Pennsylvania. The firm also represented the Horsham and North Wales Water Authorities. These Pennsylanaia providers all had water supplies that were badly tainted with PFAS. Our firm has successfully represented their interests in these historic billion-dollar settlements with 3M, DuPont, Tyco Fire Products, and now BASF.

While representing our local water providers, we also participated in the national effort to seek compensation for all public water providers. Cohan served as the Co-Chair of the MDL’s Public Water Provider Committee and, in that role, helped water providers achieve this impactful settlement that will improve the lives of all Americans.
