Charles J. Kocher is a member of the class action practice group at Saltz Mongeluzzi Barrett & Bendesky P.C. located in Philadelphia.  Mr. Kocher has a national class action practice, providing representation to individuals in cases involving consumer fraud and deception, product liability and product defect, wage and hour claims, and electronic data breach litigation.  Mr. Kocher also has extensive experience in the representation of whistleblowers in health care fraud cases brought under the federal False Claims Act.  Mr. Kocher's practice also concentrates on antitrust, unfair competition and complex business litigation.  Mr. Kocher has been selected as a team leader in one of the largest antitrust class actions in the United States - the Containerboard Products Antitrust Litigation.  Mr. Kocher is frequently invited to participate in antitrust cases by other law firms throughout the country.  His creative use of the class action device has also resulted in what is believed to be the first certified class action brought under the Pennsylvania Uniform Fraudulent Transfer Act to recover monies for victims of a Ponzi scheme.  As a result of Mr. Kocher's class action practice, he has tirelessly worked to obtain class-wide settlements in excess of $399 million.

 

Mr. Kocher has achieved successful results on a number of significant and multi-million class action cases, including:

  • Containerboard Products Antitrust Litigation:  Partial settlements of $376 million (team leader in antitrust case involving cardboard products).
  • Trabakoolas v. Watts Water Technologies, Inc., et al., No. 12-cv-01172 (N.D. Cal) (counsel in product defect class action involving a defective plumbing product resulting in a $23 million settlement).
  • Fleischer v. Fiber Composites, LLC, No. 12-cv-01326 (E.D. Pa.) (lead counsel in product defect class action involving composite decking).
  • Carroll v. Stettler, et al., No. 10-cv-2262 (E.D. Pa.) (lead counsel in first ever class action under Pennsylvania Uniform Fraudulent Transfer Act, achieving over $2 million in judgments and settlements for the class).

 

Education, Training and Experience

Mr. Kocher is a cum laude graduate of Georgetown University (2001) and holds a J.D. law degree from the Villanova University School of Law (2004), where he served as a managing editor of the Villanova Law Review.  Upon graduation from law school, Mr. Kocher was a law clerk for U.S. District Judge Clarence C. Newcomer, a celebrated judge who sat on the federal bench for more than 30 years in the Eastern District of Pennsylvania.

Prior to joining Saltz Mongeluzzi Barrett & Bendesky, Mr. Kocher worked on a wide array of legal matters - from pharmaceutical products liability litigation to white collar matters - at a large national law firm.

Honors and Memberships

From 2013 through 2017, Mr. Kocher was named as a Pennsylvania Super Lawyer - Rising Star, a listing of the top 2.5 percent of attorneys in the state who are 40 years old or younger.

An active alumnus of Villanova Law School, Mr. Kocher is a member of the Villanova Law J. Willard O'Brien American Inn of Court, a nationally recognized and award-winning member of the American Inns of Court - the oldest, largest, and fastest growing legal mentoring organization in the country.
