Ben Baer is a personal injury attorney who focuses on helping catastrophically injured clients.  He has successfully handled cases involving construction and workplace accidents, auto and crashworthiness accidents, aerial lift tip overs, electrical accidents, and defective or malfunctioning products.  Ben has obtained significant seven and eight-figure verdicts and settlements, with recoveries totaling nearly $100 million.

Ben was instrumental in securing the largest reported settlement for a single plaintiff in the history of Philadelphia County.  Ben fought diligently for his client, a landscape worker who was rendered quadriplegic after an auto accident because those responsible for maintaining his work truck failed to remove dangerous tires.  The case resulted in a $26.55 million recovery.

Ben also represented the family of a two year old child who was tragically killed after falling into an animal exhibit at the Pittsburgh Zoo.  This case received both national and international media attention.  It resolved confidentially.

In 2017, Ben was recognized a "Rising Star" by Pennsylvania Super Lawyer due his excellence in the practice of law.  This peer selected honor is reserved for the top 2.5 percent of all attorneys under 40 years old in Pennsylvania.

 

Education, Training, Experience and Honors

Ben has excelled at trial advocacy both in the court room and in the class room.  He graduated with honors from the nationally ranked LL.M. (Master's of Law) in Trial Advocacy program from Temple University Beasley School of Law.  After graduating, Ben was invited to join the Temple University faculty and currently lectures for the trial advocacy program for both J.D. and LL.M law students.

Prior to joining Saltz Mongeluzzi Barrett & Bendesky, Ben had a distinguished career as a prosecutor for the Philadelphia District Attorney's Office.   While a prosecutor, he tried more than fifteen jury trials as lead counsel and handled hundreds of nonjury trials in the Court of Common Pleas and Municipal Court.  He prosecuted major felony crimes including: shootings, stabbings, attempted murders, robberies, kidnappings, and other violent crimes.  Today, Ben uses his significant trial experience fighting for the victims of crime to better advocate for his current clients at Saltz Mongeluzzi, Barrett & Bendesky.

Before working as a prosecutor, Ben attended the University of Pittsburgh School of Law where he received his J.D. and the John P. Gismondi Civil Litigation Certificate in 2007.  Ben won the Murray S. Love Mock Trial Competition and was recognized as the tournament's top advocate.  Additionally, Ben was recognized with an individual award as the top overall student in Advanced Trial Advocacy.  Ben also clerked for the Honorable Ralph J. Cappy, Chief Justice of the Pennsylvania Supreme Court.

Ben is also a professional certified aerial lift operator.  To gain this certification, Ben passed written examinations and practical testing on both mobile vertical scissor lifts and mobile boom lifts.   This unique experience allows him to better represent those injured in aerial lift tip overs and the families who have lost a loved one in tip over accident

Currently, Ben practices across the Commonwealth of Pennsylvania, with a focus in Philadelphia and Allegheny Counties.  He is a member of American Association of Justice, Pennsylvania Association of Justice, Philadelphia Trial Lawyers Association, Philadelphia Bar Association, and the Brandeis Law Society.  Ben is also a member of the Future Leaders Executive Committee of the Philadelphia Trial Lawyers Association.
